| 中文摘要 | 海事案件多為跨國案件,惟在實體審判前,首先牽涉準據法、管 轄權等問題。而且,實務上屢有各造當事人皆非美國籍,船舶註冊地 及事發地點亦在他國,原告却選擇至美國起訴之奇特現象。為何要至 美國訴訟,理由不一,可能涉及船舶所有人限制責任制度下之求償上 限、海事優先權順序優劣,或擔保基金分配多寡等。而美國法院是否 決定受理,做為海事管轄依據,除聯邦有民事訴訟法及州有長臂法可 延伸管轄外,實務另得以公共利益為由,決定是否受理或拒絕管轄。 本文擬以發生於海峽兩岸,且由美國法院判決之個案,研究美國海事 管轄,以期釐清爭議。 |
| 英文摘要 | Maritime cases are mostly transnational, but before the substantive trial, they first involve issues such as applicable law and jurisdiction. In practice, there is a strange phenomenon in which the plaintiff chooses to sue in the United States despite all parties involved non-U.S. citizens, the ship’s registration place registered and the location of the incident happened in other countries. This phenomenon may have many reasons, including the ceiling of claims under the U.S. Limitation of shipowner’s liability system, the priorities of maritime lien, or the amount of security funds allocated, etc. On the contrary, there are also many reasons whether a U.S. court has intention to have jurisdiction to decide disputed issues or not. In addition to the Federal Rules of Civil Procedure and the long arm statutes of the states that extend jurisdiction to the foreign countries or areas, the case law also determines whether to accept or refuse jurisdiction based on public interest. This article intends to study the cases that occurred on both sides of the Taiwan Strait and judged by U.S. courts. This article may clarify this issue. |
