英文摘要 | The main object of this paper is to articulate the fading human image reflected from the civil suit in a court. Since the reform of Civil Procedure Law in Taiwan has been successfully transformed into legislation announced to protect human right more delicately. Through the discussion in this paper, we can find out the litigation remains single-voice and linear style in its dialogue process. The author tries to use the Semiotic Square introduced by structuralist semiotician Algirdas Greimas to analyze the different meanings of law in three contemporary Taiwanese novels. According to the analysis, there is an abundance of connotation about law in this hybridized society. By extracting fictional characters from each novel, the author synthesizes an activated text shifting the novel's protagonists into a lawsuit. In the simulated assemblage, we found the heteroglossia of law mentioned above will be formatted into a regulated monoglossia track. The controversy is those legal reformists believe in the universal conception of human right and not only thus but canonize their belief as disciplinary. They have neglected the spatiotemporal form-and-content of law in this postcolonial society. As the result, the monologue-power manipulation installed in this legal discourse brings out the diminishing of subjectivity they claimed to defend. The conclusion suggests only by means of camivalization of legal discourse, a real architectonics of human dignity can be set up in the suit process. |
