中文摘要 | 不論從本土化的變遷觀點,或從國際化的競爭觀點,台灣都需要強化政府的效能 ,目前所推動的政府再造,確有其必要性與時機上的切合性。然而,此一跨世紀的政府改 造工程,在精省的效應下,似有太過偏向組織人力精簡的現象。對於政府制度層面的深層 反省與興革反而有太過薄弱的疑慮。 本文首先檢討政府再造的內涵,並主張在掌握政府再造中從官僚典範轉移至企業典範 的理念層面以及組織與人力精簡的模式外,更應重視政府再造的制度興革模式,從個別制 度的外在環境與內在結構,做合乎原本制度目的及行政效能的制度興革。本文接著以環境 影響評估為例,說明如何針對該制度所面臨的外在發展趨勢,進行制度興革,以因應政府 再造。 本文發現,在考量環境影響評估制度的興革之際,必須考量四大外在發展趨勢:包括 提昇國家競爭力理念下的程序集中的要求、國土規劃興革中以土地為本位的發展趨勢、憲 法兼籌並顧條款理想實踐下的程序細緻化要求、以及電子化政府所帶動的資訊變革。惟有 對此等趨勢作精確的掌握,並做相應的制度因應,才能掌握政府再造的核心議題。雖然本 文以環境影響評估為例,但相信文中對制度興革的思考方向,可做為其他相關制度興革的 參考。 |
英文摘要 | It is well recognized that regulatory efficiency in Taiwan should be improved in view of domestic transition or national drive for international competitiveness. The enterprise of government reinventing as implemented by the government is thus both desirable and well timed. As a result of implementing provincial downsizing, however, the government reinventing enterprise seems to have leaned too much to reorganization and personnel relocation and stayed away from genuine regulatory reform. This paper first analyzes three model of government reinventing, namely paradigmatic shift in government operation, organization downsizing and regulatory and procedural reform. It then argues for a more serious regulatory reform that reflects changes in external and internal regulatory environment, taking the existing environmental impact analysis as an example. This paper identified four development trends that are to affect the future of environmental impact assessment: procedural reform arising from national drive for internatinoal competitiveness, land-oriented development planing, due process requirement from constitutional mandate and information revolution arising from the bid for electric government. A serous regulatory reform should response to the said four trends. Findings here could also be applied to other areas in respondinig to the governement reinventing enterprise. |
