中文摘要 | 為了解民眾不信賴司法的原因,本研究試將法官的量刑行為視為一種判斷決策。 進而就量刑因素的結合模式與量刑的刑度,探討法官與一般民眾間是否有差異。研究方法係 採用資訊整合理論的實驗方法(Anderson, 1981,1982),將受測者分為法官、檢察官、律 師和一般民眾四種角色,分別接受「交通過失」與「環境污染」兩種案例施測,以獲得「犯 罪所生之損害」及「犯罪後之態度」兩項量刑因素的資訊結合模式。研究結果發現:個別的 受測者大多使用相加(adding)模式結合「犯罪所生之損害」及「犯罪後之態度」兩項量刑 因素。四種角色群產體分析之結果,均採用相加模式,並無差異。另外角色不同對量刑的刑 度並不生影響;案例類型不同則僅對一般民眾在量刑的刑度產生影響,且環保案件的量型重 於交通案件,對其他具法律背景的受測者群體則不生影響。 |
英文摘要 | Integration models of sentencing factors and seriousness of the sentencing is experimentally studied in an Information Integration Framework (Anderson, 1981, 1982) where judges, prosecutors, lawyers, and average citizens are used as subjects. Two types of task (traffic accidents and environmental pollution) are employed, and damage of the offence and attitudes afterwards are considered as most of the individual subjects, throughout different subject groups; seriousness of the sentencing is not affected by subject groups; and while average citizens consider a more serious sentencing for environmental pollution tasks, type of task is apparently not affecting the judicial judgments by other subject groups with background in law. |
