| 英文摘要 | The interpretation of the general personality right clause in Article 990, Paragraph 2 of the Civil Code has sparked heated debate in academic circles. The core of the controversy lies in whether this clause should directly transplant the doctrinal connotations of "human dignity - general freedom of action" from the German Basic Law. Can Articles 37 and 38 of the Constitution be interpreted analogously to Articles 1 and 2(1) of the German Basic Law? The current academic tendency to directly transplant the German theory of general personality rights overlooks the unique connotations of the concept of personal dignity in the context of the Constitution. The root cause of this phenomenon is the lack of a complete doctrinal interpretation path of “personal freedom - personal dignity” in Chinese constitutional law. In fact, “personal freedom” and “personal dignity” in the Constitution jointly construct the overall framework for the protection of personality rights. "Personal freedom" emphasizes the protection of the intrinsic and ethical social relationships of individuals, while "personal dignity" focuses on the social manifestation of individuals, maintaining their external characteristics and social status. The general personality right in Article 990, Paragraph 2 of the Civil Code should be viewed as a concrete embodiment of Articles 37 and 38 of the Constitution in the civil law domain, rather than a simple transplantation of German legal theory. |
