中文摘要 | 本文擬運用三種不同價值觀點,針對我國身障者之定額進用政策作一探討。以往學界對於該項議題,泰半運用法律與經濟學之觀點,由社會公平與經濟效率的面向切入,申述立論。事實上,依據多數人的認知,要兼顧兩種相互競合的價值觀,實屬不易,必須有所取捨,否則易於出現倫理困境。果如此,行政人員該如何行事,方能防止偏差產生,遂為探討重心。本文嘗試從社會團結價值觀,以公共精神為出發點,加以論述,俾利瞭解與反省身障者定額進用政策之利弊。全文共分六節,除前言與結論外,依序為關於身障者工作權有那些法律保障?他國的成功經驗為何?爭議問題係如何產生?以及如何調和「定額進用」的分歧觀點?運用規範性邏輯思維方式,本文結論指出,行政機關與人員應本於社會團結觀點,針對政策窒礙難行之處,以及相關配套措施進行討論,以落實憲法對於身障者權益之保障。 |
英文摘要 | This paper is about the quota system for disabled person by applying public ethics. As usual, when discussing this topic, most papers use a view of law or economics, and stress the importance of social fair and efficiency. In fact, it is uneasy to take care of both sides. Owing to competitive values, a tradeoff emerges between social fair and efficiency. How do administrators handle these dilemmas becomes the subject of this essay. From the value of public spirit, this paper tries to realize and retrospect the merits and demerits of the quota system. Using the logical thinking of normative research method, the conclusion indicates that to ensure the rights of disabled persons, the administrators must mend the paradox of distance and the problem of the quota system. |
