中文摘要 | 於海牙規則,運送人應盡謹慎之注意使船舶適航,為其首要義務。適航性除船舶本體外,亦應就人員之適格加以判斷。運送人未盡適航性之相對義務,即無法主張航管過失等各項免責事由,藉以免除其因此所致貨物滅失或毀損之責任。現今國際上各類船舶應執行國際安全管理規章,按該規章規定,若船員經驗不足,其即不符合該規章之要求。新近台灣高等法院高雄分院一百年度海商上字第六號民事判決即就前議題討論之判決,本文即參酌相關國際公約與國內法之規定就相關議題加以論述,文末並對於本案判決妥適與否加以討論。 |
英文摘要 | In Hague Rules, the carrier was relieved of an absolute obligation of seaworthy, that was long-standing practice in common law and it was instead replaced with a duty of exercising due diligence to make the ship seaworthy. The carrier can’t exemption or limited from their liability for cargo damage or loss, otherwise they prove to make the ship seaworthy in due diligence. The purpose of the ISM Code is to establish minimum standards for safety management and operation of ships and for pollution prevention. Prior to the ISM Code, it was no written proof of the carrier’s efforts. If the Code have properly implemented, it could be the best evidence for carrier to prove that they have make the ship seaworthy in due diligence. This article will have more discussions on these relevant issues. |
