中文摘要 | 近數十年來,臺灣地區經濟快速成長,土地開發盛行。政府為因勢利導,以謀極大化社會全體之福利,遂訂定各類相關法規,對土地開發加以規範。演變至今,臺灣現行土地開發法規乃雙軌制:除原有之土地使用分區管制外,再實施開發許可制於某些類型之土地開發。雙軌運作下,衍生出一些課題頗值檢討。行政院經建會擬將開發許可制,推廣運用至各類型之土地開發,前瞻雙軌整合為單一之開發管制體制,本文遂有構想之研提。 |
英文摘要 | Taiwan has experienced rapid economic growth for the past decades. As a result land development has been active. Inaorder to guide land development so as to maximise public welfare, related laws and regulations have been implemented. Currently land development is regulated under a dual system: a universal zoning system and development permission system applied to some types of development. After examination the dual system exopses issues to be dealt with. The Government plans to advance the application of the development permission system so as to embrace all types of development. To consolidate the dual system into an intact development control system, some ideas are proposed by this paper. |
