英文摘要 | What kind of accidents happens most frequently at sea? Certainly without any doubt, one would think of ship's particular average. A particular average loss, as per definition given by the Marine Insurance Act 1906, is a partial loss which is caused by a peril insured against and which is not a general average loss. And how should the insurer indemnify the ship owners for the loss they sustain? The sole criterion for the repaired damage is the reasonable cost of repirs if the ship is being repaired, but not exceeding the sum insured. For years, the controversy still exists in the cases where the ship has not been repaired. The acceptable legal formula for the calculation of depreciation arising from the unrepaired damage still remains unretrieved. What is the true essence of insurance? Indemnity to the assured or windfall to the shrewd ship owners? The answer is still yet to come. |
