中文摘要 | 本主之分析旨趣在於,以理論導向的評估途徑,進行分析畫灣地區公營事業團體協商體制的特質,指陳該體制的現存困境及建構改造之道。而這個分析旨趣之達致,乃以代理理論、交易成木論、體制論及衝突管理理論,分別評估團體協商體制,而找出該體制蘊存的弱點,進而提出種種改造的要點:刪除強制入會的規定、改變單元工會制的結構,增加「不公平勞動措施之處置」、釐清協商單位、取消工會理事長任期限制、明確規範協商議題與建立合理而有效的糾紛處理制度。最後本文認為:單一組織理論,實無法解釋或評斷團體協商體制的全貌,而提出整合理論分析模式,以為後續研究的基礎,開展更宏觀的整體視野。 |
英文摘要 | The analytical interest of this paper is to utilize theory-drivern evaluation to analyze the features of collective bargaining of Public Corporation in Taiwan, specify its drawbacks, and construct reinventing strategies. The way to achieve this analytical interest is to base on agency theory, transaction cost, institutionalism, and conflict management to evaluate the present system of collective bargaining of Public Corporation. After this evaluation, the authors think that the present labor relations policy should be changed. The aspects needed to be redesigned are: 1.to terminate the provision of union shop (i.e. compulsory membership); 2. to modify the structure of one shop one union; 3. to regulate the ways to solve unfair labor practice; 4. to determine appropriately the bargaining unit; 5. to call off the limitation of union leader, service term; 6. to define clearly the scope of bargaining; 7. to establish a reasonable and effective conflict resolution system. The final part of this paper conc1udes that single organizational theory can not explain or evaluate the whole pictures of collective bargaining. It is necessary to constructs a more comprehensive model for future studies. |
