| 中文摘要 | 隨著兩岸中國民間交流及經貿活動日益密切往來的必然結果,海峽兩岸均已接受對方人民或企業申請商標、專利並保護彼此人民的著作權,然在我國臺灣境內卻曾有大陸地區人民在此間向法院提自訴我同胞違竑著作權法嗣經法院判決不理的案例出現,則兩岸在此方面究應如何調整保護政策及其間差異以符對等之公平,遂引發本文研究動機。 本文僅擇對討論兩岸商標法規定的差異,包括: 一、消費者利益的保護:兩岸商標法之立法目的均列有保護消費者利益之文字,但我國商標法內文諸條規定仍未見有明顯、直接與保護消費者利益有關之規定,而中共商標法則有多條規定要商標使用人保證商品質量。 二、相同或近似商標的使用:我國商標法有正商標、聯合商標、防護商標的級度,中共的商標法則沒有類似的規定,雖大陸在其實施細則中規定商標註冊人對其在同一種或類似商品上註冊的相同或近似的商標必須一併移轉,在立法技術上仍未能週延。 三、刑罰規定:中共商標法本身就違犯行為沒有刑罰規定,而是由人大常委會頒布「關於懲治假冒註冊商標犯罪的補充規定」加以規範,儘管如此兩岸對侵犯商標專用權的處罰,構成要件與刑罰卻仍有不同,致會有在大陸地區不構成犯罪的行為,在臺灣地區卻可能觸犯刑罰規定,就此情形應否有兩岸關係條例第七十八條的適用,非無勘酌餘地。 四、行政執法:從政執法:行政執法是中共商標法的特色,我國商標法並無相當的規定,在世界其他各國的立法例中亦屬少見,本文試分析其規定。 五、註冊商標的標示:我共商標法要求商標專用權人於使用註冊商標時要標明註冊商標或註冊標記,我國商標法對此則無硬性規定。 六、其他:諸如兩岸商標種類、已使用未註冊商標的保護、商標專用權的設質、行政爭訟的審級、商標代理人的委任、大陸辦理商標事務的二級該轉等制度之比較說明。 七、小結。 |
| 英文摘要 | The Chinese Governments of both sides of the Taiwan Strait hereinafter cited Strait have accepted applications of patents and trademarks and protected copyrights from the other side. However, there was one case filed by an individual of china was dismissed by Taiwan Taipei District court under Article 78 of the Act of People Relationship on Both Sides of the Strait. That was the motive of this paper. This paper discuss the major differences between the Trademark Laws of the both sides of the Strait only: A. The Protection of consumers' benefit: the goal of the Trademark Laws of both sides of the Strait include the protection of consumers' benefit. There is not any protection obviously relating to the protection of consumers' benefit in Taiwan trademark Law, but there are several provisions in China Trademark Law requiring the users of trademarks to assure of the quality and quantity of the goods. B. Use of same or similar trademarks: there is a principal mark, associated mark and defensive mark system under Taiwan Trademark Law, but China Trademark Law does not have similar provision. Though the enforcement Rules of the Trademark Law requires that the same or similar marks registered by the same one in same or similar goods should be transferred at the same time, there is defects in legislative skill. C. Penalty provisions: there is no penalty provision in China Trademark Law itself but supplemented by "Supplement Regulations of Punishment on Crimes of Counterfeiting Trademarks". However, the constitions and penalty of crimes of infringing trademarks are difference in the two Trademark Laws. Some acts do not commit crimes in China will be crimes in Taiwan. If Article 78 of the Act of People Relationship on Both Sides of the Strait is a applicable in such situations is worth study. D. Administrative enforcement: Administrative enforcement is a special feature of China Trademark Law. There is not similar provisions in Taiwan Trademark Law. It is also not common throughout the world. This paper tries to analyze the regulations. E. Expression of registered trademarks: China Trademark Law requires trademarks users to express that their marks have been registered when use. Taiwan Trademark Law does not require so. F. Other: Catogaries of marks, Protection of used marks without registration, Mortgage of trademark rights, Procedures of administrative actions, Trademark agents, Two step transference of trademark affairs in China. G. Conclusion. |
