| 英文摘要 | In the early years following the dissolution of the Soviet Union, independent Russia pursued a pro-Western European-Atlanticism, supporting the judgments and legal positions of the European Court of Human Rights, and making efforts to align with European human rights and rule of law standards. However, as the political constraints imposed by the European Court of Human Rights in Russia-related cases gradually became more prominent, the applicability of its rulings, legal positions, and the European Convention itself in Russia faced increasing scrutiny. The Russian Federation Constitutional Court began to alter its legal stance, and the country subsequently amended the "Law on the Constitutional Court" to provide legislative support for the active defense of national sovereignty and the rejection of international court rulings. The relationship between Russia and Europe proceeded along a tortuous path, marked by conflict and compromise over sovereignty and human rights. However, due to fundamental differences on political, security, sovereignty, and human rights issues, Russia and the West ultimately fell into a geopolitical trap, leading to the rupture of Russia-Europe relations — Russia's withdrawal from the Council of Europe. Russia's efforts to balance national sovereignty, human rights, and collective security, both in theory and judicial practice, have entered a new historical phase. |
