| 英文摘要 | There are two situations where the employer unilaterally terminates the labor contract with the employee. One is the situation of "retrenchment dismissal" and the other is the situation of "disciplinary dismissal". In the case of "retrenchment dismissal", the employee is protected by notice and severance pay. In the case of "disciplinary dismissal", that is not the case. There are two situations in which a laborer unilaterally terminates the labor contract with the employer. One is the situation of "voluntary resignation" and the other is the situation of "forced resignation". In the case of "voluntary resignation", the employee must notify the employer before resigning, but in the case of "forced resignation" there is no need for it, and the employee can also request severance pay from the employer. Workers have different rights in these four situations-" retrenchment dismissal", "disciplinary dismissal", "voluntary resignation" and "forced resignation". This article initially explains the reasons for the unilateral termination of the labor contract by the employer or the worker, and hence explains the differences in the rights of the worker under these four types of situations. In order to strengthen the nursing staff's impression of such legal knowledge, this article attempts to illustrate the situations of retrenchment dismissal, disciplinary dismissal, voluntary resignation and forced resignation by providing an example for each of those situations. Hopefully through the presentation of actual cases and explanations, the nursing staff will be able to understand difficult legal knowledge more effectively, and hopefully this article can assist nursing staff obtain legal knowledge regarding the termination of labor contracts, that will also protect their own labor rights. |
