| 中文摘要 | 聯合國反貪腐公約於2005年生效,我國為加強反貪及肅貪力道,為接軌國際反貪趨勢,健全預防及打擊貪腐體系,於2015年公布「聯合國反貪腐公約施行法」,並由總統簽署聯合國反貪腐公約加入書,同年12月9日開始施行,使聯合國反貪腐公約規定具有國內法律效力,2018年我國提出首次國家報告,2022年提出第2次國家報告,每次報告都會經國際審查,由國際專家學者提出結論性審查意見。針對這些審查意見,政府每年邀集國內專家學者,提出落實各項結論性審查意見之策略,然公務員對於國內專家學者針對結論性審查意見所提出的策略,他們的之認知觀念將影響推動步驟,攸關反貪腐成效。爰本研究採用探索主體性科學(science of subjectivity)的Q方法論,深入研究公務員視角下的重點策略,透過21位公務員的Q排列,發現國內關於如何得以落實國際反貪腐合作的各種措施與想法當中,存在著六種潛在論述:(一)強化定罪與執法作為預防貪腐主軸、輔以認知推廣與審慎立法;(二)明確界定貪腐行為邊界,建構跨域協力執法機制;(三A)以廉潔品德教育為本,並強化法規與制度配套措施;(三B)推動由上而下之公部門反貪腐體制、建立反貪人才專責機制與職能強化;(四)透過資產追繳與揭弊者保護機制,重建司法公信力與反貪威信;和(五)「處己以正」,建構獨立且完善的反貪腐體系,並落實組織責任。這意味著我國負責落實反貪腐政策的政府公務人員可能抱持著六種不同的策略觀點,可以提供政府在擬定反貪腐政策與方案時參考,並依此提出研究發現與建議,作為未來實踐反貪腐策略的參考。 |
| 英文摘要 | The United Nations Convention against Corruption came into effect in 2005. Republic of China (Taiwan) promulgated the "Law for the Implementation of the United Nations Convention against Corruption" in 2015. Taiwan submitted its first national report in 2018 and the second one in 2022. These reports were scrutinized by international experts and scholars, and they provided conclusive review opinions. In response to these review opinions, the government invites domestic experts and scholars to propose counter strategies for local implementation. Without doubt, civil servant's subjective judgments regarding the proposed strategies will affect the results of implementation. This study uses Q methodology to investigate the potential dimensions of local civil servant's perceptions about the effectiveness of these strategies. The study reveals six potential discourses: (1) Corruption prevention should be the core strategy, supplemented by promoting, and legislation is prudent; (2) To clarify the gray areas of corruption and to establish cross-boundary collaborative mechanism to combat corruption; (3A) To cultivate citizen's anti-corruption virtue, supplemented by strengthening anti-corruption regulations and institutions; (3B) To reform government anti-corruption system from bottom up, and to cultivate anti-corruption talents; (4) To implement various anti-corruption measures for rebuild judicial credibility; and (5) To establish an independent and fine-turned anti-corruption system with carefully assigned responsibilities. These six types of opinion indicate six different strategic viewpoints regarding how effective these strategies can be implemented. Practical suggestions are also proposed in this study. |
