| 中文摘要 | 臺灣在面對國土計畫時代來臨之時,面對既已出現在農地上「合法」和「非法」的建築現象該如何解釋,並透過政策規劃進行面對?這些建築是由使用者、投機者和投資者自行建造的,但卻與國家權力產生衝突。為何國家在此領域選擇缺席並視而不見?視而不見的效果是什麼?這是否讓政治實體和政治人物灰色地帶中有更多自由發揮及自我想像的空間,構築空間地景和產業藍圖?本文將透過國家力量對空間規劃的漠視到正視,記錄過往的空間規劃邏輯,並透過都市計畫農業區的經典案例討論──闡述既有未登記工廠、農建地,及其他事業目的主管機關所許可之,等 5不應屬於農業範疇的各式建築如何產生?公權力又在其中扮演了什麼樣的角色?在國土計畫時代來臨下,國家又是如何透過都市計畫、工廠管理輔導法、國土計畫等公權力解決臺灣農地散亂無序的發展亂象,進而強化政府監管及輔導、保障環境與公眾利益、推動社會進步發展。 |
| 英文摘要 | As Taiwan faces the advent of the “spatial planning” era, how should we explain the "Legal" and "Illegal" construction phenomena that have appeared on farmland and deal with it through policy planning? These buildings were built by users, speculators and investors themselves, but conflicted with state power. Why has the state chosen to be absent and turn a blind eye in this area? What is the effect of turning a blind eye? Does this give political entities and politicians more freedom to use their imagination in this regulatory ambiguity to construct spatial landscapes and industrial blueprints? This paper will discuss the classic case of urban planning through the disregard of the state for spatial planning, and explain how the existing factories and constructions within agricultural zones, and other legal construction permitted by the competent authority of the intended enterprise that should not belong to the agricultural category are created, and what role public power plays in them. As the era of spatial planning unfolds. How does the state use state power through Urban Planning, Factory Management Act, Spatial Planning, etc. To solve the chaotic and disorderly development of Taiwan’s agricultural land, and then strengthen government supervision and guidance, protect the environment and public interests, and promote social progress and development. |
