中文摘要 | 隨著我國近幾十年來勞動法令之發展,勞動契約已發展成具有高度人格從屬性與社 會要素的性質。各項勞動法令在性別的適用上並無差異,但某些條文中針對女性勞工的 勞動權益則定有特別的規定。 在勞動基準法中針對女性勞工的特殊規定有夜間工作時間、產假及哺乳時間,在性 別工作平等法中則是有生理假、產檢假、產假及育嬰假之規定。另外在職業安全衛生法 中,則是就妊娠中與分娩後未滿1年之女性勞工,訂有從事相關危險性或有害性工作之 禁止規定;至於女性勞工母性健康保護實施辦法,則要求雇主應對有母性健康危害之虞 之工作,採取危害評估、控制及分級管理等健康保護措施。這些規定影響女性藥師的勞 動權益甚鉅,因此藥師應對此議題多加留意。 |
英文摘要 | Over the past few decades, labor contract was highly developed with subordinate personality and social element. Application of labor acts has no differences in gender, however, there are few special statutes of female laborer stipulated in various labor acts. For female laborer, night working hours, maternity leave, breast feeding time are stipulated in Labor Standards Act. Moreover, menstrual leave, leave for pregnancy checkups, maternity leave and parental leave are stipulated in the Act of Gender Equality in Employment. Furthermore, Occupational Safety and Health Act stated prohibitive regulations for female laborers who are during pregnancy or still within their first postpartum year that involved in dangerous or harmful work. As for the Regulations of the Maternal Health Protection, employers shall institute hazard assessments, controls, and hierarchy management measures for work which is potentially hazardous to maternal health. These statutes exert a profound influence on labor rights for female pharmacist, so we should pay more attention on these issues. |
