中文摘要 | 台灣地區宗教團體自光復後迄今之宗教建築物與土地違規使用問題,已有相當程度的普及性,是政府治理宗教事務最感棘手的問題,長期困擾著宗教團體。依內政部民國101年12月的資料,國內未登記宗教場所有13,466家,這些未登記的寺廟主要原因是寺廟違章建築或土地違規使用。另就正式登記與補辦登記的比例55%:45%計算,尚有約6,800家因土地或建築物違規使用的寺廟設施。在這些違建寺廟中,包括陽明山國家公園內的某些寺廟,已然影響國土的城鄉風貌。 依據民國97年的調查,在陽明山國家公園內有74間寺廟,其中高達69間屬違建。由於這些違建寺廟位於敏感的國家公園範圍內,在輔導過程中,因牽涉到的法令繁多,以及政府不同單位之間的權責問題,以致陽管處在管理、查處及輔導上,感到有心無力。 本文透過田野調查與深度訪談途徑,搜集陽明山國家公園內的宗教設施及土地使用管理問題的案例,分別就管理者、建築物及土地權屬、所在區位、限制發展地區及條件發展地區等項目加以檢核、分析。 |
英文摘要 | Since Taiwan’s retrocession, building and property issues have been very prevalent among Taiwan’s religious groups. It is the most intractable long-standing problem plaguing governmental governance of religious organizations. According to data from the Ministry of the Interior, as of December 2012, there are 13,466 unregistered religious sites in Taiwan, mostly comprised of illegal buildings and land misuse. Comparing those registered and those needing to re-submit their application for formal registration yield a ratio of 55%: 45% respectively; there are approximately 6,800 temples without construction permit due to illegal use of land or buildings. Some of these illegal religious buildings are located in Yangmingshan National Park, impacting negatively the urban and rural landscape of our nation. According to a survey in 2008, among 74 temples in Yangmingshan National Park, up to 69 are illegally built. The fact that these illegal complexes lie within the national park, an eco-sensitive reserve, poses a major challenge to National Park Administration for two specific reasons: complicate regulations with numerous applicable decrees on the one hand, and involvement of different government units on the other hand. These two elements are intricately commingled, affecting effective governance and counseling services of National Park Authority. Through field surveys and in-depth interviews, this paper collects information from case studies on religious facilities and land management issues in Yangmingshan National Park. Investigations and analysis were carried out on various aspects, such as managers, buildings and land ownership, locations, transportation, development prohibited areas, and zones for permitted conditional development. |
