中文摘要 | 但教授與蔡逸佩同學的文章認為,儒家思想和人權理念之間,不僅沒有扞格,而且還有合契之處(我稱之為「合契論」)。我這篇評論將針對這個主張,提出幾點意見。(一)我同意合契論的說法,即儒家思想傳統中隱含了有助於我們理解、接受「人權」理念的思想資源,但類似的分析應該也可以適用到其它非西方文明傳統的社會。(二)合契論的說明功能,也因而相當有限,因為雖然我們可以同意合契論,但並不表示我們可以依賴「忠恕之道」來決定人權的清單。(三)在當前國際人權實務的共識下,可以列入人權清單的項目,非常可能不同於以合契論為基礎的人權清單,這篇文章並未考慮到這一點。 |
英文摘要 | In their thought-provoking article, the authors contend that Confucianism is not incompatible, but congruent with contemporary idea of human rights. I offer some comments on this contention. First, the Confucian Principle of Doing One’s Best and Be Considerate of Others, properly understood, may help us acquire contemporary concept of human rights, but this is true of the core doctrines of many non-Western civilizations. Second, although at the conceptual level, the Confucian Principle is not incompatible with contemporary idea of human rights, this fact alone does not tell us how to settle the list of human rights. Third, the Confucian Principle of Doing One’s Best and Be Considerate of Others plays insignificant role in explaining the list of human rights now settled in the international regime of discourse and practice concerning human rights. |
