中文摘要 | 本文之目的是要對臺灣過去十幾年來預防及處理工作場所性騷擾事件所投注之努力,做一整體之回顧與檢視,並分析二○○二年制定「兩性工作平等法」(現已更名為「性別工作平等法」)之相關條文。除序言及結語外,全文共分四個部分:第二部分根據幾項相關調查,說明此一問題在臺灣之嚴重情形。第三部分列舉性別工作平等法之相關規定。第四部分剖析此法所建構防治工作場所性騷擾法制之優缺點及引起爭議之處。最後,則是根歔歐美國家之經驗,指出相關當事人(包括雇主)所應採取之因應作為。 |
英文摘要 | The purpose of this article is to provide a general account of the problem of sexual harassment in the workplace in Taiwan in recent years and to analyze how the Gender Equality in Employment Act of 2002 responds to this emerging issue. Aside from introductory and concluding remarks, the main contents of the article are divided into four sections. Section II uses a number of local surveys to illustrate the prevalence and seriousness of sexual harassment problems in Taiwan in general and in the workplace in particular. In Section III, the major provisions dealing with sexual harassment at work in the Gender Equality in Employment Law will be discussed. Section IV provides a detailed evaluation of the related provisions of the law, including their merits, demerits and controversial aspects. Finally, this article offers several suggestions for employers to further improve their practices, prevent these incidents from occurring and protect their rights and interests if they do occur. |
