中文摘要 | 本文說明德國法學教育受當代衝擊與回應而提出改革選項,其衝擊主要是來自於為達成歐洲高等教育一致化目標所發表之波隆那聲明。本文先說明波隆那聲明之內容與要求,其次則討論現行德國法學教育之概況與問題,以及波隆那聲明對其造成之挑戰為何。接續,說明波隆那模式下之高等教育內容,所謂3 2模式或4 1模式,如何轉化成德國法學教育改革選項內容。最後,提出本文結論,在德國法學教育改革中,背後隱藏的「制式法律人」圖像主宰法律教育。如未能突破此一傳統圖像之束縛,欲達成法學教育之多元性與適應時代性,根本是遙不可及之目標。 |
英文摘要 | This article describes the reform options of legal education in Germany against the contemporary challenges and the impacts, which mainly arise from the Bologna Declaration in order to achieve the goal of integrated higher education in Europe. First of all, this article shall describe the contents and the requirements of the Bologna Declaration. Secondly, this article will discuss the current profile of the German legal education and its problems, as well as what are the challenges which the Bologna Declaration brings about. This article also presents the contest of higher education under the Bologna's model, the so-called 3+2 or 4+1 mode, and how it transforms to the reform options of legal education in Germany. Finally, the conclusion was also made in this article, that is: the key to the current legal education reform in Germany is the invisible but dominant image of "Einheitsjuristen". If the shackle of this traditional image could not be broken, the goal to the diversity of legal education and to adapt to the times should be totally unattainable. |
