英文摘要 | The focus of this essay is the philosophical foundation of human rights, a topic presented by Conor Gearty, the Rausing Director of the Centre for the Study of Human Rights and Professor of Human Rights Law at the London School of Economics and Political Science, in the Humlyn Lectures of 2005. It argues that whilst Gearty's identification of ‘compassion’ as the basis for human rights is praiseworthy, his thought lacks a coherent philosophical basis. Hence, the essay seeks to supply such a basis by turning to aesthetics and noting how here there are certain similarities between the fields of human rights discourse and aesthetics. Indeed, the parallel with aesthetics also helps to confirm another topic of interest to Gearty, namely the role of a legislature, as opposed to legal experts, in defining rights. The essay suggests that a similar interplay between experts and the general public happens in the field of art, with the ultimate decision in the public's hands and not in that of the art critics. Apart from providing a more coherent philosophy for rights discourse, the essay also looks at issues of terminology and draws on the phenomenological works of Edith Stein and Emmanuel Levinas as well as on Confucian sources to give a deeper and more accurate foundation than that provided by the term ‘compassion’. |
