中文摘要 | 本文旨在透過對「原住民族工作權保障法」、「公務人員特種考試原住民族考試規則」與「台北市促進原住民就業自治條例」中,對我國原住民於公部門中工作權保障之條款的立法精神、條文內容與實施成效,進行探討;並剖析我國公部門原住民工作權保障上,需待解決的問題,以及未來此一領域的政策該如何修正,方能有效落實公部門原住民工作權保障的政策宗旨。 |
英文摘要 | The Indigenous Peoples are the most disadvantaged ethnic group in Taiwan for the last fifty years. They are always in a poor employment situation. Although central and local governments had enacted several laws and had implemented a series of programs to protect the Indigenous Peoples Employment Rights in the public sectors. But the bad employment situation still exists. This article intends to analyze the three main laws in this policy area, the first one is “Indigenous Peoples Employment Rights Protection Act” enacted by Legislative Yuan, the second one is ”Regulations for Civil Service Special Examination for Indigenous Persons” enacted by Examination Yuan, and the third one is “Promoting Indigenous Peoples Employment Act in Taipei City” enacted by Taipei City Council. The goals and values of the three laws intending to pursue in the three laws; the performances of the three laws accrued, the shortcomings of the three laws to be solved, and the policy recommendation of the modification for the three laws all will be studied in this article. |
