中文摘要 | 「言論自由」關乎民主政治之健全運作,以及憲法保障該自由的法理基礎,誠如美國法哲學家德沃金在《自由之法》所言:「其核心在於擁有不受妨礙可以抒發己見的權利,而這是一個自由社會組成結構的基本特徵」。在政治實踐上,這種廣泛抽象的意見表達之自由,主要是透過司法審查來落實與確立,使該基本人權的價值與內涵能夠具體化。 臺灣從威權專制脫胎民主之轉型過程,不僅社會環境劇變,對於人權理念與人權保障也愈趨重視。是故,為探索司法審查與人權保障之間的實質關係,觀察大法官對社會變遷的回應性,本文歸納整理了我國司法院大法官會議共十三則「言論自由」憲法解釋文,並簡要分析三個不同歷史分期裡,大法官會議解釋所展現的不同人權意涵。直言之,早期大法官並無對言論自由有過具體的宣示,遲至九十年代第五屆任期末段,才逐漸浮現人權理念的思考;另大量回應社會解除管制與人權保障之要求是在第六屆大法官,故這一時期解釋文特色是引進西方司法審查理論與原則做為強化釋憲論證的合理性;而政黨輪替之後,現行不分屆次的大法官會議則以持續深化人權理念、保障言論自由為司法權行使要務。 |
英文摘要 | “freedom of speech” is the constitutional rights and the legal foundation of democratic institution. As an American law scholar Ronald Dworkin said “It is an essential and constitutive feature of a free political society and the point of free speech is an absolute moral right to ensure their own mind free.” in Freedom's Law. In political practice, this abstract “freedom of expression” is not only have been fulfilled and protected from judicial review but also embodies the value and content of basic human rights by judicial review. From authoritarian regime to democratic transition, Taiwan society change so quickly that we should care about how to protect human rights more seriously. For examining the real relations between judicial review and protecting human rights, observing the right ideas of Grand Justices, this article explore thirteen constitutional interpretations of “freedom of speech” by Grand Justices of Judicial Yuan in Taiwan. For this aim, we analyze the interpretation meanings of human rights in different history period. In my conclusion, Grand Justices didn't take freedom of speech seriously until the end of the fifth Grand Justices during 1990s, there are some words about human rights in constitutional interpretation. But the sixth Grand Justices more concern about social freedom and protecting human rights than before. For reinforce the rationality of interpretation reasoning, they start to introduce and use the theory and principle of western judicical review. And after the first party tumover (from 2000 to 2005), Grand Justices cognize their duty for human rights and claim judicial power to protect freedom of speech seriously more than before. |
