中文摘要 | 國外直接投資(Foreign Direct Investment, FDI)近年來快速發展,促進了全球的經濟發展。多年來,國外直接投資已經變成世界經濟成長最主要的原動力之一,而到目前為止,有關國外直接投資的相關法令制度,在國際組織體系仍未完全建制完成,在1995年由經濟合作開發組織(Organization for Economic Cooperation and Development, OECD)草擬的多邊投資協定(Multilateral Agreement on Investment, MAI)目標即在於提供一個廣泛多邊的國際投資制度,並提出一套國際投資爭端解決的機制,以保障跨國投資者的權益,然而,OECD會員國在磋商時產生極大歧見,且大部分開發中國家全力反對此一協定內容,導致多邊投資協定最後胎死腹中;在目前新一回合的世界貿易組織(World Trade Organization, WTO)談判中,部份已開發國家欲將之前於經濟合作開發組織(Organization for Economic Corporation and Development, OECD)架構下磋商之多邊投資協定,推展至WTO的架構下談判,面對此一形勢,開發中國家擔心對其本身之經濟自主權在談判過程遭受犧牲;因此,如何能在被投資國國內經濟發展的需要,與國際投資所能帶來的經濟效益中,找到一個平衡點,是一個在國際經濟體系下兩難的問題,但可以預見的是,在國際經濟自由化、國際化及制度化的趨勢下,多邊投資協定重回談判桌的可能性幾乎是肯定的;本篇文章以為開發中國家的態度,在未來WTO的議題中,將扮演一關鍵性的角色,故本文希望藉由開發中國家的經濟發展觀點,評析此一架構下的多邊投資協定。 |
英文摘要 | During the past few decades, foreign direct investment (FDI) has rapidly increased and has enhanced the world's economic growth. Although FDI has become one of the major driving forces of global economic development, related international investment legal instruments has not been adequately established yet. Under the new round of WTO negotiations, some industrialized countries have suggested drawing the OECD's proposed Multilateral Agreement on Investment (MAI) into the World Trade Organization (WTO) for future processes. Facing this new trend, many developing countries fear that their national and economic sovereignty may be compromised in future WTO negotiations. As a consequence, finding a balance between economic gains from FDI and economic sovereignty presents a challenge for developing countries. Is FDI a necessary mechanism for developing countries to promote their economic growth? With different developmental models and a myriad of different economic difficulties, is a uniform global investment instrument suitable to meet the different demands for developing countries? This article will examine current international investment regime and its influence in developing countries. |
