中文摘要 | 政府管制政策的改善絕非一蹴可幾,系統化與科學化的政策評估顯然是提升政府管制措施效能的重要關鍵及前提,而此種概念與實務即是所謂的「管制影響評估」(Regulatory Impact Assessment;RIA)。有鑒於我國尚未建立系統化的「管制影響評估」制度,本文因此將作一探索性的文獻檢閱,同時輔以OECD先進國家管制影響評估及管制革新的實施經驗,以期對政府管制政策績效評估的概念和實務有更進一步的瞭解,並可做為我國未來發展管制影響評估制度時之參考。本文計分為五個部分:緒論說明研究之背景與動機;第二節探討政府管制所衍生的相關成本問題,以突顯必須建立「管制影響評估」制度的理由;第三節討論「管制影響評估」制度的評估準則與目標,並以OECD先進國家之制度經驗做為佐證;第四節將由整體管制革新的系統性觀點,勾勒出政府管制政策評估的基礎架構與相關配套措施;第五節則為本文結論。 |
英文摘要 | Regulatory Impact Assessment (RIA) is being increasingly used as a tool for appraising the costs and benefits of new regulation proposals and evaluating the performance of existing regulations. RIA is also a process that contributes to better governance, by improving transparency and accountability of public decision making. By now, more than half of OECD countries had adopted RIA programs, up from one or two in 1980s, and an increasing proportion of laws and other regulations affecting citizens are being shaped in part by various forms of RIA. However, a sound framework for RIA is still lacking in Taiwan. An exploratory literature review of OECD countries' experience on the execution of RIA is therefore conducted to have further understanding to the concepts and practices of RIA and provide references to the future adoption of RIA in Taiwan. This paper discusses the legitimacy building requirement for the implementation of RIA in terms of regulatory assessment criteria, such as transparency, accountability, targeting, proportionality, and consistency. This paper also proposes a generic framework for RIA that can be applied to improve regulatory decision-making and outcomes. |
