中文摘要 | 「限制出境」並非「限制出每」。在臺灣法律上既無限制出海之規定,出海亦非即出境,因為海岸線並非領海界限,而是以領海質線起算十二浬為範圍。其於依法行政原則,行政行為應遵守法律及一般法律原則。漁民出海捕魚,屬於憲法所保障之工作權。尤其是本案之漁民申請在領海內捕魚一未越出領海境界。因此,以「限制出海」來達到「限制出境」之目的,應非法之所許。 |
英文摘要 | A ban on leaving the country is different from a ban on leaving a seaport. A ban on leaving a seaport is not ruled by law in Taiwan. to leave a seaport does not mean to leave the country because the coast is not the boundary of territorial waters which is twelve feet counted from the front line of the territorial sea. Moreover, based upon rule of law, the agency action must follow the law and the legal principles. To fish, a right to work, is protected by the Constitution. Specifically, the fisherman in this case may fish inside the territorial sea but not across the border of the territorial sea. Therefore, it is shall be not legally allowed to ban the right of a citizen to leave a seaport to attain the goal of confining one who has been restricted from leaving the country alternatively. |
