| 中文摘要 | 國際禱的是以國家為主體而組成,而國家間彼此往來的關係即是國際關係。由於國際關係日益複雜,跨國互動頻繁,相互依敏關係加深,使得一些國家為了某些共同利益而結合組成組織,這就是政府間國際組織的濫觴。這類組織進年來有數目上的成長非常快速,而且展現出不同程度的複雜性與專門化。益當前國際關係中,國際組織顯然正發揮重大的影響力,從而使其在國際法中佔有重要地位。 然而,隨著國際法規範的範圍日益擴大,以國家為主體的國際組織顯然難以因應所有的國際問題。國際社會存在一些雖具有類似國家性(statehood)但卻未被承認為國家或欠缺國家要件的領實體,也有如香港、澳門、關島或波多黎各等為某國的殖民地或特別行政區的領域實體,這些領域實體能否參與國際組織或條約,即出現不同的法理解釋。 眾所周知,世界貿易組織不是以國家為成員的國際組織,而是以政府為主體的國際組織,對於國家定位有顧義的「非國家領域實體」能否參加該組織,在國際法上是一個重要的問題。本文旨在從國際社會實踐與學者的理論,釐這些領域實體參加國際組織的法地位,對中華民國臺灣未來參與其他國際組織將更有參考價值。 |
| 英文摘要 | The international community is composed of nations, and the interactions between them form international relations. Due to the increasing complexity of international relations, interactions, and interdependence, some nations sharing common interests begin to work together to create international organizations, one after another. The number of this kind of international organizations is rocketing in recent years. Each organization features a different degree of complexity and distinctiveness. In the current global community, international organizations are exerting profound influences and, therefore, assuming a significant role in international laws. However, with the expanding realm of international laws, international organizations consisted of nations are meeting more and more challenges in dealing with international issues. In the world, there are non-state territorial entities, such as Palestine, Taiwan, Namibia before independence, and East African National Liberalization Front. These entities are either not recognized as nations or unable to meet the definitions as a nation. Besides, there are other similar entities, such as Hong Kong, Macaw, Guan, Porto Rico, other countries’ colonies and special districts. Whether these territorial entities can participate in international organizations or treaties depends on different applications and explanations of laws. It is known worldwide that the members of World Trade Organization are governments, not necessarily nations. As a result, the participation of non-state territorial entities in WTO is an important issue in international laws. Based on the realization of international society and related theories, this thesis aims to clarify the legal status of these entities in international organizations, serving as a reference for Taiwan’s future involvement in the global community. |
