中文摘要 | 本文旨從正當程序的程序性與實質性來探討學校行政的「程序正義」與「實質正義」。文章首先說明行政程序的意義與程序保障在學校行政的重要性。其次,探究「正當法律程序」(due process of law)的概念,並從意義、特徵、基本要件及適用情形來分析學校行政的正當程序之意涵。此外,為更進一步闡述學校如何踐行正當程序,乃以教師解聘處分為例,從相關法律規定歸納出,學校解聘教師所需要遵循的實質性與程序性之正當程序。最後作者提出個人建議並作成結論。 |
英文摘要 | The purpose of this article was to explore "Procedural justice" and "Substantive justice" of school administration from the procedural due process and the substantive due process. At first, the article illustrated the meanings of administrative procedures and the importance of procedural safeguards for school administration. Then, it discussed the concepts of "due process of law" and analyzed the context of due process for school administration from the meaning, characteristics, fundamental elements, and appliances. Besides, in order to further explain how schools put "due process" into practice, the article gave an example of teacher dismissals and had a conclusion of the procedural due process and substantive due process, which a school needs to dismiss a teacher from correlated laws. Finally, the author gave suggestions and conclusions. |
