中文摘要 | 二十一世紀是個多元文化的世紀,性別的議題乃是多元文化所關注的主要課題之一。兩性工作機會不均或待遇不公的情形在臺灣的職場中時可目睹或耳聞,但臺灣婦女長久以來似乎也習慣了,原因可能是忍氣吞聲,或者是抗爭無效而放棄該有的權利,直到女權運動與女性主義的興起,衝擊了許多婦女同胞的內心,開始反思是否該讓不均與不公的現象持續下去,或是該有所行動爭取應有的權益。事實上,爭取權利的行動不一定需要採取激烈的抗爭或敵對的態度,而宜以理性合理為出發點去思考如何改善現況。兩性工作平等法的產生是個尊重女性工作權很好的開端,經由立法的程序使兩性工作的權利與保障得以明文化。然而,筆者發現兩性工作平等法的法條並完美無瑕,其中仍有值得討論之空間,故希望藉由此文提出個人的拙見,引發對兩性工作平等法關心的人士提出更多的建言,以便讓立法相關的先進們參考,進而使臺灣的兩或工作平等法更切合人心及實際需求。 |
英文摘要 | The twenty-first Century is an era of multicultural, and multicultural education also greatly concerns the issue of gender. In Taiwan, it has long been quite common to see inequality between males and females in the work environment. Females in Taiwan seemed to be accustomed to accepting the unequal status or thought they were unable to compete with males. Therefore, they did not struggle for the rights they should have. When the movement of female right began and feminism appeared, women in Taiwan began to think about what rights they should have and began to make efforts to get these rights. The Gender Equality in Employment Law was implemented in Taiwan in 2002 to help ensure women's working rights. Although this was a step toward respecting females in Taiwan society, there is still room to improve the law because articles of the law are not comprehensine. By analyzing the Gender Equality in Employment Law, the author hopes to raise more concerns about this issue and encourage improvements to the law. |
