中文摘要 | 基於工會法第四條規定:「各級政府行政及教育事業、軍火工業之員工,不得組織工會」。我國教師因此長期無法成立工會,爭取工作條件之改善。雖然民國八十四年通過之教師法,開放教師組織「教師會」但是此一組織仍不具備協商權及爭議權,僅有參與及諮商的機會。事實上,已開發國家率以憲法或制定法保障公共部門員工組織及加入工會的權利。而針對地方教師會理監事的問卷調查結果亦顯示:大多數理監事支持組織教師工會。因此,本研究建議應修己女教師法,賦予教師會協商權及爭議權,同時教師會應兼顧「工會主義」及「專業主義」兩種發展途徑。 |
英文摘要 | According to article 4 of the Trade Union Law, teachers, government employees, and workers in munitions factories are prohibited from organizing a union. Hence, Taiwan teachers can not form unions to improve working conditions for decades. Although, the Teachers' Law, promulgated in 1995, provides teachers with the right to organize the association. But the association does not have collective bargaining and dispute right. It only have some consultation and participation opportunities. In fact, the right of public employees to organize and join unions is protected by Constitution and statutes in developed countries. According to the Survey of members of executive council and board of supervisors at regional level teachers' associations, by mail questionnaires, also indicate that most of members support the right to form unions for teachers. For this reason, this study suggests that Teachers' Law should be amended to allow the teachers' associations to have collective bargaining and dispute right. At the same time, the teachers’ associations in Taiwan should take both the professionalism and unionism approach. |
