中文摘要 | 聯合國籌建之時,普遍主義(Universalism)與區域主義(Regionalism)各有其支持者。最後前者成為主流。聯合國憲章將維持國際和平與安全的主要責任託付給聯合國,區域組織依照輔助性原則只扮演輔助和次要的責任。亦因此故,憲章實是兼採區域主義與普遍主義。由於制訂憲章時,各方勢力較勁,憲章的有關條文常曖昧不明,可以做不同的解釋。憲章雖然將維持和平與安全的主要責任劃歸聯合國,但是並未明確規定聯合國與區域組織在維持和平與安全時職權的分工與合作。冷戰結束後,聯合國維持和平與安全的工作大增,對區域組織分擔責任的期待殷切。聯合國與區域組織雖然亦有不少分工合作的案例,但是似乎與憲章規定的原則與精神不盡相符。 由區域組織分擔維持和平的責任,不僅可減輕聯合國的負擔,亦可使維持國際和平與安全的工作「民主化」。區域組織熟悉區域內的情形,與聯合國相比,更能有效處理區域內的問題。 然而區域組織亦有其缺點,最大的缺點是權力結構。區域組織如果是由小國組成,則本身的力量有限,無法干預區域內的動亂。區域組織如果是由一個區域強權和小國合組而成,則在區域強權願意出錢出力的情形下,有維持區域和平與安全之能力,但是會員國國力的不對稱,會使區域強權掌控或主導該區域組織,將之作為其外交政策的一項工具,從而危害該區域組織之公正地位。 聯合國的公正性通常不會有問題。因此聯合國與區域組織在維持國際和平與安全的分工時,應發揮各自的優點,以彌補彼此的缺點。在賴比瑞亞的案例中,西非經濟共同體的干涉,受到西非強國奈及利亞的影響,自始即不具有公正性。在喬治亞的案例中,俄國假藉獨立國協之名,干涉喬治亞的內戰,立場並不公正。 在賴比瑞亞和喬治亞案例中,聯合國與區域組織採取「共同部署」(co-deployment)的合作方式;在前南斯拉夫的案例中,雙方則採用多種「承包」(sub-contracting)的合作方式。合作與分工的方式因個別情形而各有不同,但是皆以實用為依歸。 1992年6月17日,聯合國秘書長蓋里(Boutrois Boutrois-Ghali)向安理會提出名為「和平的議程」(An Agenda for Peace)的報告中,指出區域組織在處理許多區域衝突的問題上具有潛力,應加以運用,協助預防外交、維持和平、製造和平,和建造衝突後的和平。他認為,基於聯合國憲章的規定,安理會在維持國際和平與安全上,負有重要責任,過去如此,未來亦如此;但是聯合國基於分權、授權和合作而讓區域組織處理區域性衝突,不僅減輕安理會的負擔,亦可使各國對國際事務有更多的參與、共識,和民主化的感受。他也指出,區域組織的活動如果符合憲章的宗旨和原則,如果區域組織與聯合國(尤其與安理會)的關係是依照第八章的規定,則區域組織的貢獻會很大。 本文的主要目的有二。第一是說明聯合國憲章制訂過程中,區域主義興起的背景,以及憲章對聯合國與區域組織之間關係的規定。第二是以若干實例顯示後冷戰時期,區域組織並未依照憲章規定而從事區域衝突或爭端的解決,安理會亦未嚴格按規定行事。 |
英文摘要 | In the San Francisco Conference which convened to establish the United Nations (UN), both universalism and regionalism had their advocates. The UN Chapter finally given the Security Council (SC) the primary responsibility for maintaining intemational peace and security; regional organizations are to play a supporting role. But the relevant articles in the Chapter have been subject to various and incompatible interpretations. During the Cold War period, the great powers preferred to let the regional Organizations under their effective influence deal with regional disputes and security problems. In the post-Cold War era, the UN's burden for keeping peace and security greatly increased, and regional organizations have been encouraged to share the burden. However, the cooperation and division of labor between the UN and the regional organizations are not entirely in keeping with the Chapter provision. Regional organizations are more familiar with the problems in their own region, hence, in principle, can deal with them more efficiently than the UN. The main defect of the regional organizations lies in their power structure. If they are composed of a regional power and several small staies, the regional power tends to use the organizations for its own benefit, thereby impairing their impartiality. The purposes of the article are twofold. First, it tries to explain the background for the rise of regionalism by the end of the Second World War, and the relations of the UN and regional organizations as stipulated in the Chapter. Second, it reveals through several post-Cold War case studies that in dealing with regional conflict, regional organizations and the SC failed to act according to the Chapter provisions. |
