中文摘要 | 本文之目的,是要對各國際組織近年來對抗工作場所性騷擾此一現象所從事之各項努力,尤其是歐洲聯盟之相關作為,做一整體評估,並說明未來可能之發展趨勢。除緒論及結論外,全文共分四大部分:第一部分檢視聯合國及其附屬機構對此一問題所採行之各項對策,由於聯合國及國際勞工組織均尚未對工作場所性騷擾頒布任何具法律拘束力之公約,來供會員國遵循或參考,因此,主要是以國際貨幣基金會及世界銀行所發布之相關聲明為重心。第二部分則是對其他國際組織,諸如國際自由工會聯合會、歐洲工會聯合會及歐洲產業與雇主聯盟各自針對此一問題所述之立場,做一大體之說明。第三部分探討歐洲聯盟各會員國及該國際組織所採行之對策,將以四個階段為期,對它在這方面之努力做一回顧。最後,本文討論歐洲聯盟制定相關統一性立法所引起之論爭,以評析國際組織從事這方面努力所可能遭遇到之困境及阻力。 |
英文摘要 | The purpose of this paper is to make an over-al1 assessment of efforts made by various international organizations, especially the European Unions (EU), in combating sexual harassment in the workplace. It also tries to examine future developments. In addition to introductory and concluding remarks, the contents of the paper can be divided into four sections. Section One describes the endeavors made by the United Nations and its specialized agencies in confronting this issue. Since the U.N. and the International Labor Organization (ILO) have not adopted binding conventions for their members, the paper will concentrate on the internal regulations promulgated by the World Bank and the International Monetary Fund. Section Two makes a general observation about policies adopted by other related international organizations, such as the International Confederation of Free Trade Unions (ICFTU), the European Trade Union Confederation (ETUC), and the Union of Industrial and Employers' Confederation of Europe (UNICE). Section Three evaluates measures made by the EU itself and its member states in handling this issues. It discusses various international instrumentalities put forth by that organizations in four periods from 1976 to the present. Finally, in Section Four, the paper studies the difficulties encountered by the EU in adopting a binding regulation or directive to solve this new issue in the workplace and concludes that it is still impossible to establish such a mechanism in the international community in the forseeable future. |
