中文摘要 | 歐洲聯盟(以下簡稱歐盟)自1958年歐洲經濟共同體成立以來, 已經歷經四次的擴大,歐盟的蓬勃發展大大提升了歐洲各國國內與 整體的經濟實力,連帶也促進了歐洲合的進行。對1989年以來致 力進行改革開放的東歐國家而言,成為正式的歐盟會員國,不只對 其近年的改革是一種肯定,也是另一種穩定與經濟成長的保證。所 以莫不積極爭取加入歐盟。 歐盟決議從1998年起,與匈牙利、波蘭、捷克、愛沙尼亞、斯 洛文尼亞與塞浦路斯六國展開入會談判。對於其他也提出申請入會 的國家,歐盟將在2000年之後,再與其商討入會細節。新申請的國 家,除了塞浦路斯外,一般在政治民主化及經濟發展程度上,和歐 盟國家有一定的差距。本文將只針對目前政經情勢發展較佳的波蘭、 捷克與匈牙利加入歐盟的談判過程例作分析,東歐國家加入歐盟的 影響,將大致可見。 本文除了從歐盟的角度與申請國的角度切入,分析當前歐盟的 第五度擴大,各方利益與衝突的所在,目前波、捷、匈符合入會標 準的程度如何?與未來的談判重點與解決方式外,最主要還要從新 現實主義、聯邦主義等國際關係與整合理論的分析架構出發,對波、 捷、匈三國與歐盟執委會談判的過程與協商的內容作分析,以探討 東歐國家加入對歐盟發展的影響,和可能的發展。 |
英文摘要 | The purpose of this article is to provide a comprehensive, comparative analysis of the Institution of the Referendum and its relationship to Democratic Consolidation in Taiwan. The analysis should enable us to develop a normative model for referendum and to create an explanation of the various positions the institution of Referendum can acquire in different settings of national or local decision-making. The referendum is not a precondition for democracy, but a properly designed and utilized Referendum can enhance the legitimacy of a constitutional and political system and contriubute to democratic governance. Constitutionally, a democratic regime is consolidated when govermental and non-governmental forces alike become inhabited to the resolution of conflict within the specific laws, procedures of the referendum. The prospect of democratic consolidation after the Presidential election is inevitably determined by the degree of national identity conflict and the possible course of Taiwan-China relation in the near future. In other words, as long as the PRC stands ready to infilitrate Taiwan's domestic political process and threatens to subvert, with the use of force if necessary, and democratically elected government that promotes Taiwan Independence, Taiwan's new democracy will have a difficult time on its way to consolidation. We then concerned the implications for democracy of different strategies of referendum. |
