中文摘要 | 本文將歐洲統合的經驗作為兩岸推的統點的思考。全文分為四個部分。第一部分以聯邦主義、功能主義與新功能主義來分析中國大陸與臺灣現有的政策。本文認為以新功能主義推動兩岸統合較為可行。第二部分論述兩岸統合的方向,其中認為現有學術界對有關兩岸共同體的討論其實只是一種功能合作,而不能算是統合的範疇。本文在這一部皆提出兩岸統合是兩岸「主權共儲與共享」的概念,以及提出四種不同的「兩岸財」的概念,以作為討論未來統合範疇的依據。第三部分提出一些可以運作的統合實例以為參考,例如兩岸可在農業事務、臺海社會案全事務、南海事務等方面成立共岣體進行統合。第四耜分則對歐盟機構運作的情形,以及它們在兩岸未來統點中可能有的參考側?提出看法,其中並討論盟在國際間以一個國際法人出現對於兩岸的參考價值,以及兩岸以「整個中國」(或兩岸共同體)名義與臺灣及中國大陸(總共三個國際法人)共同參與國際組織的法律意義。 |
英文摘要 | This article endeavors to work out a way to promote cross-strait integration with Europe’s integration as a model for study. The first part gives an overall survey of the respective policies of Mainland China and Taiwan with regard to their cross-strait relations from the view of federalism, functionalism, and neo-functionalism. The author concludes that neo-functionalism is a more feasible basis from which to discussions cross-strait integration. The second part explores current discussions on cross-strait integration. One major point put forward in this section is that the current discussion in the academic circles across the Taiwan Strait is in fact a type of functional cooperation and cannot be deemed as integration the author advocates a key conception of sovereignty “reserved and shared” by both sides of the Taiwan Strait and also proposes four different “cross-strait goods” as the basis for future talks on integration. The third part lists possible practices for cross-strait integration. For example, the two sides could set up cross-strait organizations in the fields of agriculture, social security, and South China Sea affairs. The final part of the article analyzes EU operational procedures and its possible value of reference for future cross-strait integration. The author gives special attention to EU’s presence on the international stage as an “international person,” and studies the legal problem for the two sides of the Taiwan Strait to participate in international organizations as three international persons: the China as a whole (or cross-strait community), Taiwan, and Mainland China. |
