中文摘要 | 在全球民用航空市場自由化的進程中,毫無疑問地,在不同國籍的航空公司間為 增加收益、降低營運成本,進以擴大航空市場佔有率的競爭日益白熱化,乃紛紛訂定各種各 樣的合作行銷協議,結合成各種策略聯盟的經濟實體,其中又以星際聯盟與寰宇一家最為著 名。 顯然,代碼共用的最重要作用,能對消費者而言,不論是直達航班或者是轉機航班,皆能以 最合適的價格,享受到搭乘飛機時無與倫比的服務、選擇與便利性。對實施代碼共用的航空 公司而言,透過門戶城市或主要據點,在不增加航班或指定航空公司的情況下,也能將經營 利潤最大化,造成旅客及航空公司間三贏的局面。 然而,代碼共用的法律效果殊值吾人重視,尤其是因實施代碼共用造成損害時,有關準據法 以及負損害賠償責任之人的相關法律問題,特別是在華沙公約體系中關於契約運送人與實際 運送人責任之歸屬問題。最後同時也是最重要者,即代碼共用的實施可能對航空市場造成的 負面效果,國際間對此問題尚未達成一致的共識。然而,諸如國際民用航空組織以及國際航 空運輸協會等國際組織對此問題的各項研究方案,吾人亦應應隨時觀察並注意其動向,以為 我國籍航空公司在與它國航空公司簽訂代碼共用協議時之參考依據。 |
英文摘要 | In the process of liberalization in global civil aviation markets, it is beyond a reasonable doubt that competition, inter alia, among airlines of different nationality, is drastically vigorous by reason of both increasing revenues and reducing operating costs with a view toward to expanding aviation market share. In these circumstances, airlines take initiative actions to enter into a variety of cooperative marketing arrangements in an attempt to create virtually economic entities in the form of strategic alliances for which Star Alliance and Oneworld are well-known in this particular sphere. It is obvious that the most significant functions to be performed by code-sharing lie in the fact that the consumers can afford to travel by air, whether through on-line or inter-line services, in the amount of reasonable airfares commensurate with unparalleled level of service, choice and convenience in flight, on the one side. On the other, however, airlines signing code-sharing agreements can maximize their profits to be made, without increasing flights or designated airlines, through gateway cities or main hubs in the corresponding countries. This results in the most perfect context in which both passengers and airlines are pleased to accept. Nevertheless, it should be born in mind that legal effects arising from code-sharing arrangements remain matters noteworthy enough for us to pay more attention, which arouse legal issues within the domain of applicable laws and persons to be responsible for damage or injury to be sustained therefrom, particularly those pertaining to the liability to be imposed upon among contracting carriers and real carriers under Warsaw Convention System. Last but not the least, code-sharing may cause negative effects within the province of aviation markets, upon which no consensus exists in international community. Irrespective of non-consensus, it should also be observed that international organizations such as International Civil Aviation Organization and International Air Transport Association take their initiatives to make as many researches and surveys as possible, which can be employed as rationale fundamental to the signing of an international air transport agreement to which our flag carriers are contracting parties. |
