中文摘要 | 我國強制汽車責任保險法於87年1月1日實施,機車部皆業於88年1月1日,納入。由於我國汽機車數量龐大,尤其機車即有1,000多萬輛,該法不但牽連廣大,且其中甚多係參酌國外經驗與作法,而成為我國首創之設計,諸如無過失任、特吸補償基金、無虧無盈、區分為單一、及非單一,費率釐定採從人兼從車。 本文即以風險管理之參點,針對法案中相關條文逐條分析並檢視其機制是否達致損失預防與抑制之效果,以影響駕駛人用路行為,促使駕駛人小心與守法賀駛,期達道路交通安全對的;再根據研究以探應如何修正,作為未來修法之參考。 |
英文摘要 | The Law of Compulsory Auto Insurance was announced on January, 1,1998, while the Insurance of Motorcycle was announced on January, 1, 1999. Since number of motor vehicles in Taiwan is large and there are even over the million motorcycles, the law concerns a lot of people. It incorporates the relative and similar laws of other countries with our own innovation. For examples, in the law, no-fault liability, special compensation fund, no-loss, no-profit, rating-making depends on both personal factor and auto factor. This paper a thorough analysis of the law in the perspective of risk management. By examining the mechanism of the law, we would like to see if it has achieved loss prevention and loss protection, so that it can influence people’s way of driving and make them drive more carefully. This paper also discusses how to change the law to provide a reference to further amendment. |
