中文摘要 | 區段徵收是一種土地所有權先公有化,爾後再私有化與重分配的一種過程,具有土地儲備以及土地使用分區權空間重組合的作用。然而從資源管制、出租與出售觀點言,區段徵收並不是一種完全財產權,因為它在排他權、收益權、移轉權與交換權上並未構成完全財產權的內涵。本文以土地有效開發利用為基礎,在土地權屬重分配的過程中,針對現行區段徵收之缺失,就土地開發時序、開發種類與開發規模等土地使用分區權配置問題進行分析,作為修法之參考。 |
英文摘要 | Zone expropriation is a process of publiclization of land ownership firstly, and a process of privacy and redistribution secondly. It functioned as land banking, and space reorganization of land use zoning rights. However, from the view point of controlling, leasing and selling of resources, zone expropriation is not a complete property rights, because it is incomplete in its interior meaning with respect to exclusive right, profit right, transfer right and exchange right. This article studies on the basise of efficient land development, it discusses the negative point of current zone expropriation through the process of land ownership redistribution, and analyze the land use zoning rights allocation, such as the land development timing, land development type and land development scale. Hoping that this study can serve as a reference of adjustment of zone expropriation law. |
