中文摘要 | 自然法在西方文明的觀念中扮演一相當重要角色。如果沒有自然法,羅馬法絕不可能演變成為後來國際文明的普遍法律;沒有自然法,也不會有美國與法國大革命。本論文擬以(聖多瑪斯1274)自然法 (Natural Law) 學說為對象,開展吾人對自然法的認識。筆者擬先從自然法的詮釋,了解自然法的字義及定義,二則闡釋多氏三貫法論點,三則研究多氏自然法的落實,指出其與我人良知、良心的關係,四則說明多瑪斯如何以分享和類比建構起他的自然法體系;五則探究多瑪斯如何看待整體宇宙;六則探討作為道德形上基礎的自然法;最後提出多瑪斯自然法與中國文化的會通之處。 |
英文摘要 | Natural law has played an important part in western civilization. If it weren't for natural law, Roman law could not have played the part it did in shaping today's international law. Without natural law, there would have been no American or French revolution. This article would like to take St. Thomas Aquinas' natural law as its subject. It first offers an explanation of natural law, then elucidates Thomas' three point theory and proceeds to Thomas' practical application of natural law; the relationship between people and their innate knowledge and conscience. I would then like to show Thomas' use of participation and analogy in establishing his system of natural law. From there, I would like to discuss Thomas' notion of the entire universe and his use of metaphysics as a basis for natural law. Finally, I would like to point out some similarities between Thomas' natural law and Chinese culture. |
