中文摘要 | 「土地儲備制度」在外國施行有年,諸如瑞典、法國、美國等,由於政府可掌握 大批土地作為特定目的事業及中低收入住宅等之開發用地,或適時予以出租、出售,增加土 地市場經濟供給,有助抑制地價上漲,消除土地投機,與誘導都市的正常發展,對次社會整 體發展確有正面功能。「建立土地儲備制度」雖早於民國六十九年內政部召開「全國土地問 題會議」,及八十五年行政院核定「國土綜合開發計畫」內均已揭櫫建立土地儲備制度,預 備未來發展所需各類發展用地,以調節正常房地供給,防杜房地產價格不合理暴漲與土地投 資,而為我國土地政策重要的一環,惟迄今仍未能落實於法制化與具體之執行措施。本文爰 就土地儲備制度的建立,從相關學理、物權法制與實務上分析在我國實行土地儲備制度的可 行性,從多方面來探討儲備土地的可行途徑與相關配合措施,俾資土地儲備制度落實可行。 |
英文摘要 | Land banking systems have long been implemented overseas, in such countries as Sweden, France and the United States. Under such schemes, governments are able to manage the development and use of large tracts of land earmarked for such specific purposes as public enterprises or moderate to low income housing. Or governments can lease or sell such tracts when necessary to increase supply in the real estate market, thereby dampening land price rises and eliminating land speculation. This is conducive to the healthy development of urban areas and has a positive effect on the development of society as a whole. The establishment of this system was called for as early as 1980, when the Ministry of the Interior convened a Nationwide Land Issue Symposiu, and in the Comprehensive National Land Development Plan approved by the Executive Yuan in 1996. They both heralded the Establishment of a land banking system and set aside in advance all sorts of land for development as required in the future. This will allow adjustment of the supply of normal residential land and thereby avert unreasonable jumps in Land prices and prevent land speculation. This makes it an important aspect of our national land policy. However, to date, this scheme has lacked a legal framework and specific Implementation measures. This article covers the establishment of a land banking system, analyzing the feasibility of implementing such a system in the ROC in terms of pertinent theories, the legal system of in rem rights, and practicality, and in a number of aspects, discussing practicable means and pertinent coordination measures for banking land so that it becomes feasible. |
