| 中文摘要 | 依據八十年六月修正公布的公營事業移轉民營條例現行版本,已有六家事業 及三家工廠完成移轉民營,而政府計劃在未來五年內進行四十二家公營事業的民 營化。無論是過去的案例或即將進行民營化的事業,面臨移轉民營員工權益補償 相關法令適用時,往往出現法規適用的疑義,有些係因法令不周延或疏漏,有些 則肇因於與化其他法令或解釋的抵觸,特別是勞動基準法令中的勞動條或退休標 準問題,因修正或不斷擴大適用範圍,而使移轉民營條例無所適從。 本文就上述問題,從公營事業移轉民營條例員工權益內容的每一個項目,一 一分析探討,期從法律問題的釐清,幫助員工了解自身權益的內容、提供執行人 員參考,並從法制面記錄一個政府改造與體制改革中人員處理的重要經驗。 |
| 英文摘要 | The Taiwan government has been pursuing privatization vigorously as part of a liberalization porgram. The arrangement for employees is one of the major challenges during the privatization process. This paper reviews the structure of employee compenstation in the Statue for thd Transfer of Publis Enterprises to Private Ownership. It describes: the rights of employees to choose between continuing to work or departing; departure payment, length-of-service payment, additional payment of six months salary, advance notice payment of one months salary; compensation for insurance, and other types of compensation It also includes discussion of related guidelines, explanations of government and court opinions, as well as an attempt to try to resolve some controversies betweeen different laws. We hope to clarify the legal issues involved and reduce the resistance of employees to the process of privatization; |
