中文摘要 | 《未實施容積管制地區綜合設計鼓勵辦法》(以下簡稱本辦法)自民國 73 年在臺 灣地區發佈以來,全省各地均有案例出現。雖然本辦法之公益性目標明確,但在負面上,容 積獎勵與設計放寬的方式, 卻引起諸多的議論,以致經二次修正後,終於 85 年 6 月廢止 ,改以《實施都市計畫地區建築基地綜合設計鼓勵辦法》替代。由於本辦法之容積獎勵與設 計放寬造成的環境負荷,有實質造成居住密度升高,影響居住品質之虞;因此本研究針對與 居住密度有關的條文進行比較檢討,經發現有ヾ立法原旨與施行結果存有過大差距,立法品 質有待提昇與ゝ基準容積過高、缺乏擬定「路寬」上限,是造成居住密度升高、居住品質惡 化等二項重大缺失,經研究後均已各別提出可行建議,供政府未來導向密度管制,研擬相關 法令之參考。 |
英文摘要 | In 1984, "The Comprehensive Design Guide for the Unimplement Area of Floor Area Ratio Control" was issued in Taiwan. Although its purpose was for public-goodness, there were still have some arguments the policy. On account of the effect, This guide was abolished on Jun, 1996, and displaced by "The comprehensive design guide on the building site in urban planning area". Because of this policy's strong influence toward the living quality, We examine the related codes with residential density. And we find: There is a gap between intension and implementation of the code, that we need more efforts on law-making. Too much initial floor area for a site, and lack of application limits of road-width, are the basic errors which made the worse situation. So we propose some sugestions as guildlines for the contral of residential density in the future. |
