英文摘要 | For the grant of land development rights on Taiwan in the coming years, the development permission is an inevitable trend. This system not only can maintain the stability of the land supply market, but also take care of the property rights of land owners; it contains both flexibility and fairness. However, during the process of apply of land development rights, the co-condition development and refusing development will be unavoidable; in addition conflicts will be brought as well. Accordingly, this paper tries to study the way to release this kind of planning conflicts in accordance with the establishment of negotiation system, and real experience of planning agreement and development agreement of the United Kingdom and United States. The Author raise a proposal for establishing a negotiation system through view points of legislation, development efficiency, transaction cost, planning gain, fair negotiation and negotiation tech. Hoping that this study can be the reference of the establishment of the system. |
