中文摘要 | 本研究目的在於分析大眾捷運系統投資模式體制設計,以制度比較分析法探討「傳 統發包模式」與「民問投資模式」二種模式制度設計之主要差異。本研究之結果 顯示:傳統發包模式進行大眾捷運系統建設工作時,其申請甄審程序之制度設計 較為嚴謹,但是缺乏彈性,難以因應不確定性狀況;民問投資模式以甄審委員會 評定最佳特許廠商,其彈性較大,但可能引發不當投機行為。民間投資模式對於 大眾捷運系統之規剖、設計、興建、開發與營運皆賦予民問投資者較大的自主權. 並降低政府之監督與管制設計與範圍,可促使民問投資機構發揮其經營效率。但 民問投資模式並未建立適當的爭議處理機制,爭議發生時可能引發嚴重的問題。 |
英文摘要 | This paper analyzes the institutional settings of different infrastructure investment models for the public rapid transit system in Taiwan. The difference between traditional infrastructure procurement model and infrastructure privatization model is compared using institutional comparative analysis. The results show that traditional infrastructure procurement model is relative strict, but inflexible in response to uncertainty at the application and authorization stages. By contrast infrastructure privatization model is more flexible to select the best concessionaire at the application and authorization stages through the group decision process of committee, but it may induce opportunism. Furthermore, the infrastructure privatization model allows private concessionaires to have more autonomous freedom in planning, designing, building, developing, and operating the public rapid transit system, and less threat to be supervised and regulated. However, the infrastructure privatization model may bring serious problems once a dispute happens due to lack of appropriate dispute resolution mechanism. |
