英文摘要 | This paper argues that success in overcoming the challenges of Transnational Criminal Organizations (TCOs) requires the law enforcement community to improve, or reform, its conventional approach in fighting against crimes and criminals. The use of intelligence, defined as knowledge or information, activity, and organization, is believed to be able to strengthen law enforcement capacity in understanding the nature and the threats they are posing to different societies of nations and the international community as a whole as well. Furthermore, intelligence will be instrumental in containing, disrupting, and destroying TCOs. Intelligence, referred as knowledge, can be classified as Tactical, Operational, and Strategic Intelligence. Each serves its purpose in assisting law enforcement; operational intelligence can provide analytical support to the investigation and prosecution process against TCOs; and tactical intelligence enables law enforcement response to effect arrest and seizure action. Intelligence, defined as activity, includes collection, analysis, and processing of information about TCOs. It compasses all types of activities in intelligence. This paper also stresses the importance of cooperation in intelligence at all levels. Several cases of national, regional, and international arrangements in sharing and exchanging information and intelligence have been given to explain why they are needed and how they have been working and more importantly, what lessons the law enforcement community can draw from these practices. Since TCOs know no boundary in their operations, so does intelligence. However, as this paper points out, there are issues and problems in employing the intelligence approach. They are not easy to overcome, and require further study for better solutions. This paper merely provides general answer at best. A discussion as such will be useful to the understanding of the role of intelligence in law enforcement efforts against TCOs. It is the unique nature of TCOs and the threats they posed that make intelligence relevant, necessary, and essential to law enforcement. |
