中文摘要 | 為增加國有土地供給,眾所周知,政府將提供國有地使用權。但事實上,一般人很難取得此一權利,因為國有地使用權已因缺乏土地市場觀念和現行失靈的運用制度而僵化,導致國有地資源被占用和破壞情形嚴重,顯示國有地供給和有效利用之困境問題。 本文依據國有地特性和其所有權社會化理論探尋一個新的財產權-「使用權」,以為解決此一問題之法,依此新制,讓使用人-公部門與私部門,於繳納合理費用後,均能於其較長期間內使用,抵押、出租和轉讓,而國有地資源得以永續利用,是為研究之目的。 |
英文摘要 | In order to increase the national land supply, as we know, the government will provide national land with its use rights. But, in fact, we can't get more, because it was rigid for want of the conception in the land marketing and some wrong system in operation. Now, the national land resources was occupied illegally and destroyed seriously. It Showed that an embarrassed problem of the national land supply and utility. According to the characteristic of national land and the theory of the ownership socialization, We should search for a new property right a right to use system to solve its problems. Under this new land rights system. The user, either private sector or public sector, after pay a reasonable fee or rent, can get the right of the national land to mortgage, to lease, and to transfer in a longer duration, and the land is in the sustainable use, This is the objective of this paper. |
