中文摘要 | 臺灣成功的農業發展,成功地帶動了經濟的發展,使得臺灣的經濟奇蹟揚名於世。然而在今日工商業掛帥的政策下,農業反而成為經濟發展的犧牲品,尤為嚴重的是農業依以為生的土地,大量地被變更使用以及農地非法炒作之情形。須知土地為農業之根本,有土斯有農,斯有民,斯有國,因此若不能適當地管理與維護農業用地,便不能真正維繫農業的生產與發展,也不足以維持國家的生存。 臺灣早期的農地政策乃以「耕者有其田」為重心,確實達到振興農業與經濟的目的,但是歷經時代的變遷,早期的農地法令已經多不適用,甚至直接影響到現行政策與法規的執行。而農地的非法變更使用、土地投機炒作以及農地價格高漲的情形均極為嚴重,尤其是政府日前的振興經濟方案更加造成對農業土地衝擊與破壞,不可不慎行之。 就目前的土地政策而言,由於掌管土地業務的事業主管機關繁多,而各法令中對部份名辭用語的定義不一,以及相同類似的法令重覆限制或相互牽絆,是乃造成在執行與推動上的困難,也容易造成農民的混淆與誤解;日前研修中中的「農村計畫法」與「農地利用法」草案也有許多類似的缺失,實有再商榷的必要。 未來農地政策的方向,除應修正或廢除不當的法令外,應儘速完成國土重劃的工作,重新考慮區位的配置與發展,並且限制農地變更地目的方式應為徵收,在徵收後變更不成者,在限制期間內不得再行變更;同時訂定農地買賣價格的上限,以及農業生產合作社或農企業法人不得承購農地之所有權,只可具有農地的使用權。期能對農業用地作合理有效的利用與分配,並杜絕農業生產環境的破壞與農地的流失,以維護立國之根本。 |
英文摘要 | The prosperous agricultural development in Taiwan has brought great success to Taiwan herself and also has made her renowned for her economical achievement. But under the current policies we concerned only about the industry and business. Agriculture becomes a sacrifice at this moment. Especially while the farm lands are altered to un-agricultural use and are illegally sold nowdays. As we know, the land is the foundation of the agriculture. Lands are for farming, for the people, and for the country. As if we are not able to manage or persue the reasonable direction of the agricultural development, we also can't maintain its basic function on production or the survival of our country. Of the old agricultural policies, "Every farmer has his own farm field" was the main point about the land use in early days in Taiwan. It did reach the object to promote both the agriculture and economics. After time, the old regulations became improper, and even now, they still directly influence how to execute the modern policies and regulation. The situations are being seen much more often than before that the farm lands are illegally altered and sold out, as well as the prices of them are getting higher an higher irrationally. Moreover, the current policies for promoting economics put much more impact and destruction to the farm lands and those problems should not be ignored. As to the current land policies there are too many government agencies administer the problems related to the land use. They have their own definitions on some of the nouns and ages of the regulations and sometimes they repeat the same limits or conflicts between them. Those make it more difficult to execute the regulations and make the farmers confuse and misunderstand as well. Thus, there are a lot of shortages in the proposed plans "The plan of the rural villages" and "The farm-land use", surely they ought to be considered and studied again. After all, the direction of the future policies of the farm lands shall not only modify or delete the improper ones, but also complete sooner on the re-planning of the country lands. On one hands, the government shall re-consider the location and development of a land, on the other hand, they can collect the farm land which is designed to be altered to another use--the land is not allowed to be altered in some period of time, unless it is collected by government. At the same time, the government has to regulate the upper amount of prices of the farm lands, and neither the agricultural cooperations nor the juridical persons may get the farmland ownership but the right of use. It is expected that the farmlands can be reasonably used and allocated, and to stop destroying the agricultural environment and losing the farmlands, and maintain the foundation of our country. |
