| 中文摘要 | 共建國際一流美麗灣區是粵港澳大灣區實現高品質發展的必然要求與重要使命。協同治理 是粵港澳大灣區一體化發展的題中應有之義,也契合我國自然資源的治理理念轉型。粵港澳大灣區治理 主體眾多、治理事項紛繁,為此有必要通過價值鏈模型引入,以系統觀念分析粵港澳大灣區自然資源協 同治理法治諸要素。粵港澳大灣區自然資源協同治理包括了目標、組織、機制、監督四個維度的立法、 執法、司法和公眾參與的四大方面協同。針對粵港澳大灣區自然資源協同立法的規範性不足、協同執法 的組織支撐不足、協同司法的機制保障不足、公眾參與的激勵約束不足等問題,需從明晰灣區協同立法 的模式選擇及重點內容,完善灣區跨域執法的組織協同及政策工具,實現灣區實體法適用與程序性規範 的接軌以及優化激勵與約束並存的灣區公眾參與路徑等予以完善,協力高品質推進美麗灣區建設。 |
| 英文摘要 | Jointly building a world-class beautiful bay area is an inevitable requirement and important mission for the Guangdong-Hong Kong-Macau Greater Bay Area to achieve high-quality development. Collaborative governance is an inherent part of the integrated development of the Guangdong-Hong Kong-Macau Greater Bay Area, and it also conforms to the transformation of China's governance concept regarding natural resources. Given the large number of governance subjects and the complexity of governance matters in the Guangdong-Hong Kong-Macau Greater Bay Area, it is necessary to introduce the value chain model and analyze the various elements of the rule of law for collaborative governance of natural resources in the Guangdong-Hong Kong-Macau Greater Bay Area from a systematic perspective. The collaborative governance of natural resources in the Guangdong-Hong Kong-Macau Greater Bay Area includes collaboration in four aspects: legislation, law enforcement, judiciary, and public participation, across four dimensions: goals, organizations, mechanisms, and supervision. In response to such problems as insufficient standardization in collaborative legislation on natural resources, inadequate organizational support for collaborative law enforcement, lack of mechanism guarantees for collaborative judiciary, and insufficient incentives and constraints for public participation in the Guangdong-Hong Kong-Macau Greater Bay Area, improvements should be made in the following aspects: clarifying the model selection and key contents of collaborative legislation in the bay area, improving the organizational collaboration and policy tools for cross-regional law enforcement in the Guangdong-Hong Kong-Macau Greater Bay Area, realizing the integration of the application of substantive law and procedural norms in the bay area, and optimizing the path of public participation in the bay area with both incentives and constraints, so as to jointly promote the construction of a beautiful bay area with high quality. |
