| 英文摘要 | This article analyzes the legislative choices and political discourse surrounding the development of Taiwan's wage protection system, with a focus on the 1980s legislative deliberations over Article 28 of the Labor Standards Act. The debates centered on whether wage claims should take precedence over secured debts such as mortgages, whether to establish a wage insurance or advance payment mechanism, and who should be responsible for funding such a system. Despite operating under authoritarian rule, where legislators lacked formal bill proposal rights, members of the Legislative Yuan actively participated in committee reviews and plenary debates, expressing diverse viewpoints and shaping the final legislative outcome. The law ultimately adopted a compromise: granting top repayment priority to wages owed within six months and creating a government-backed wage arrears payment fund. This study foregrounds the dynamic process of policy formation rather than focusing solely on legislative outcomes. It reveals how multiple voices influenced legislative decisions and how Taiwan's wage protection system emerged from the interplay between institutional constraints, party-state negotiations, and the broader context of democratic transition. |
