| 中文摘要 | 澳門特別行政區於 2023 年 7 月完成第 14/2023 號法律《醫學輔助生殖技術》的 立法工作,有關法律自 2024 年 2 月 11 日起開始生效,當中明文禁止“代孕”、“選擇胎 兒性別”、“買賣配子、胚胎”等等行為,並將該等行為刑事化。面對醫學科技的迅速發 展,在治療性克隆技術上,該項法律採取與國家政策相同的立法取向,為澳門特區與中國 內地在這方面的科研合作創造了條件。是次立法帶來的啟示有三:1)恰當的立法,可平 衡各持份者的利益和澳門特區的公共利益,從而可解決社會出現的問題;2)法律的適時 出台,可有效促進社會的發展;3)前瞻的立法觀與靈活的立法技術,可配合日新月異的 醫學科技發展。 |
| 英文摘要 | Medical assisted reproductive technology is a special technology for treating couple infertility in the development of modern medicine. The Macao Special Administrative Region completed the legislation on medical-assisted reproductive technology in July 2023, and the relevant law came into effect on February 11, 2024. This is the first law in Macao to regulate comprehensively medical assisted reproductive technology. It explicitly prohibits “surrogacy”, “selecting the gender of the fetus”, “trading of gametes and embryos” and other activities, and criminalizes such activities. In facing the rapid development of medical science and technology, this law adopts the same legislative orientation as the national policy on therapeutic cloning technology, creating conditions for scientific research cooperation between the Macao SAR and mainland China in this area. There are three inspirations from this legislation: 1) Proper legislation can balance the interests of various stakeholders and the public interest of the Macao SAR and consequently solve social problems; 2) Timely introduction of law can effectively promote social development; 3) Forward-looking legislative view and flexible legislative technology can adapt to the rapid development of medical science and technology. |
