| 中文摘要 | 隨金融商品或服務的專業性與多樣性增加,金融消費爭議案件頻傳,處於相對弱勢地位的金融消費者,其權益遭受侵害的風險亦隨之提昇,如何建構更為有效且友善的 金融消費者保護法規範與監理措施極具重要性。而本文係對金融商品或服務在銷售過 程與售後服務可能存在的問題深入探究,並以英國金融服務暨市場法與金融消費訴訟 外紛爭解決機制等制度為參考。本文亦借鏡英國公平待客原則之相關法規範與監理制 度,以求金融業者對金融消費者應盡義務之深化,並對台灣金融消費者權益保護之相關法制提出若干建議,期可提供基礎研究供各界參酌。 |
| 英文摘要 | As financial products and services become increasingly specialized and diverse, there has been a rise in disputes related to financial consumer issues. Financial consumers who are in a relatively vulnerable position face an increased risk of having their rights violated. There is an urgent need to establish more comprehensive, effective, and consumer-friendly regulations and supervisory measures for the protection of financial consumers.This paper focuses on exploring the potential problems that may arise in the sales and after-sales services of financial products or services, taking inspiration from the regulations of the United Kingdom's Financial Services and Markets Act (FSMA)and dispute resolution mechanisms. Additionally, the paper also draws on relevant regulations and regulatory systems on the principle of Treating Customers Fairly (TCF) in the United Kingdom, to deepen the obligations of financial institutions towards financial consumers and make recommendations for the relevant legal framework for the protection of financial consumer rights in Taiwan. It is hoped that this study can provide a foundation for research and reference. |
